Terms of Service

1. Agreement to Terms

By accessing or using PocketLord ("the Service"), provided by PocketLord ("we", "us", "our"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree, do not use the Service.

These Terms apply to all users of the Service, including landlords, letting agents, property inspectors, and tenants.

2. Description of Service

PocketLord is a cloud-based property management platform that enables users to:

• Manage rental properties, tenants, and documents
• Create and track maintenance requests
• Conduct property inspections and generate reports (HHSRS, Mid-Term, HMO)
• Communicate between landlords, agents, inspectors, and tenants
• Store and share property documents and certificates

The Service is available via web browser and mobile applications (iOS and Android).

3. Account Registration

To use the Service, you must create an account. You agree to:

• Provide accurate and complete registration information
• Maintain the security of your password and account
• Promptly update your information if it changes
• Accept responsibility for all activity under your account

You must be at least 18 years old to create an account.

4. Subscription Plans and Payment

Free Plan: We offer a free plan with limited features. The free plan may be modified at any time with reasonable notice.

Paid Plans: Paid subscriptions are billed monthly. Pricing is displayed on our website and within the app. All prices are in GBP and may be subject to VAT.

Free Trials: Paid plans include a 14-day free trial. You will not be charged during the trial period. If you do not cancel before the trial ends, your subscription will begin and you will be charged.

Cancellation: You may cancel your subscription at any time. Cancellation takes effect at the end of the current billing period. No refunds are provided for partial billing periods.

Payment Processing: Payments are processed by Stripe. By providing payment information, you agree to Stripe's terms of service.

5. Acceptable Use

You agree not to:

• Use the Service for any unlawful purpose
• Upload content that is defamatory, abusive, or infringes on others' rights
• Attempt to gain unauthorised access to the Service or other users' accounts
• Use the Service to send spam or unsolicited communications
• Reverse engineer, decompile, or disassemble any part of the Service
• Use automated tools to scrape or extract data from the Service
• Impersonate any person or entity

We reserve the right to suspend or terminate accounts that violate these terms.

6. Your Content

You retain ownership of all content you upload to the Service, including documents, photographs, reports, and messages ("Your Content").

By uploading content, you grant us a limited licence to store, process, and display Your Content as necessary to provide the Service. This licence ends when you delete Your Content or your account.

You are responsible for ensuring you have the right to upload any content and that it does not violate any third party's rights.

7. Data and Privacy

Our collection and use of personal data is governed by our Privacy Policy, which forms part of these Terms.

You can delete your account and request removal of your personal data at any time through the Profile section of the app or by contacting us at support@pocketlord.com.

8. Inspection Reports and Compliance

PocketLord provides tools for creating property inspection reports, including HHSRS assessments, mid-term inspections, and HMO compliance checklists. These tools are provided as aids and do not constitute professional advice.

Important:

• Reports generated using PocketLord are based on information you provide. Their accuracy depends on your input.
• PocketLord does not certify, validate, or guarantee the compliance of any property.
• You remain responsible for ensuring your properties meet all applicable legal and regulatory requirements.
• Inspectors using PocketLord remain responsible for their professional assessments and qualifications.

9. Limitation of Liability

To the maximum extent permitted by law:

• The Service is provided "as is" and "as available" without warranties of any kind, whether express or implied.
• We do not warrant that the Service will be uninterrupted, error-free, or secure.
• We are not liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the Service.
• Our total liability for any claim relating to the Service shall not exceed the amount you have paid us in the 12 months preceding the claim.

Nothing in these Terms excludes or limits our liability for death or personal injury caused by negligence, fraud, or any other liability that cannot be excluded by law.

10. Indemnification

You agree to indemnify and hold harmless PocketLord and its officers, employees, and agents from any claims, damages, losses, or expenses (including legal fees) arising from:

• Your use of the Service
• Your violation of these Terms
• Your violation of any third party's rights
• Content you upload to the Service

11. Service Availability

We aim to maintain high availability of the Service but do not guarantee uninterrupted access. We may:

• Perform scheduled maintenance with reasonable advance notice
• Temporarily suspend the Service for emergency maintenance
• Modify features or functionality with reasonable notice

12. Termination

By you: You may close your account at any time by deleting it through the app or contacting us.

By us: We may suspend or terminate your account if you breach these Terms, with notice where practicable. In cases of serious violation, we may terminate immediately.

Upon termination, your right to use the Service ceases. We will handle your data in accordance with our Privacy Policy.

13. Changes to Terms

We may update these Terms from time to time. When we make significant changes, we will notify you by email or through the app at least 30 days before the changes take effect. Your continued use of the Service after changes take effect constitutes acceptance of the updated Terms.

14. Governing Law

These Terms are governed by the laws of England and Wales. Any disputes arising under these Terms shall be subject to the exclusive jurisdiction of the courts of England and Wales.
